Anne and Michael, who were married for eight years, have been at a separate address for the last five years, The couple have one child, Kate aged 7. The couple have never formally entered a separation agreement, however, Michael has been paying regular maintenance for Kate since he left the family home five years ago. Michael recently entered a new relationship and wants to make a commitment. When he contacted Anne about getting a divorce however, she informed him that she would never agree to a divorce. (1) Explain the legal position on divorce to Michael with reference to The Family Law (Divorce) Act 1996.
